Compliance requirements
The successful bidder must confirm that none of the exclusion grounds under § 95(1) of the Estonian Public Procurement Act apply. Before the contract is signed, the contracting authority may require supporting documents for those confirmations if the information is not freely available in a public register. The bidder must also confirm that it is prepared to explain any corrective measures under § 97 if an exclusion ground applies.
A bidder may be excluded if a person involved in preparing its bid also took part in preparing this procurement, or is otherwise connected with the contracting authority, and the resulting information advantage distorts competition in a way that cannot be remedied by other means. A bidder may also be excluded where a conflict of interest cannot otherwise be avoided, if it is being liquidated or is subject to insolvency proceedings, or if it has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty. The contracting authority may also apply restrictions on participation based on the bidder’s place of establishment or residence, as set out in the tender documents. Where permitted, the bidder may submit evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts or orders for services corresponding to or similar to the subject of the procurement during the 36 months preceding the start of the procurement. Each contract or order must have a value of at least EUR 5,000 excluding VAT. Similar services include printing plastic cards and comparable products, such as cards for people with disabilities, pension cards, ISIC cards and bank cards. For services provided under a framework agreement, completed contracts or orders placed under that agreement may be used as evidence. The bidder must provide details of the completed contracts or orders, including their dates, the client’s name and contact details, the value excluding VAT and, for public procurement contracts, the reference number. The contracting authority may contact the client and request further evidence or information, which must be supplied within five working days of the request if it is not available from public registers.
The bid must comply with the tender documents; conditional bids are not permitted. If the bid relies on equivalence, the bidder must explain it and provide supporting evidence. Joint bidders must appoint an authorised representative and include the relevant authorisation. Any information claimed as a trade secret must be identified and justified; the bid price and evaluation-related numerical figures may not be classified as trade secrets. The bidder must meet environmental requirements when providing the service and prevent adverse environmental impacts. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
The price must be entered using the structure specified in the evaluation and price fields and in the price form (Appendix 3, row F6), with the calculations checked. The provided documents do not specify the award scoring method.
