Compliance requirements
The bidder must declare whether it, or any person in its management, supervisory or representative bodies, has a relevant final conviction within the last five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion may also apply for unpaid taxes or social security contributions, enabling the illegal employment of a foreign national, or a contract that would breach an international or Estonian government sanction. The bidder may provide evidence of remedial measures to restore its reliability where permitted by law or the tender documents. Under the applicable EU restrictions, the bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or instructions.
Qualification criteria and exclusion grounds
The bidder must submit a proposed concept and completed CVs, using the buyer’s forms, for four specialists: a project manager, a creative/art director, a graphic designer and a copywriter. Each specialist must fill only one role. For each role, the proposed specialist must have participated in at least two projects in that same role during the three years preceding publication of the contract notice. Each project must have concerned creating a visual identity (CVI) and brand book under a contract with a budget of at least EUR 20,000 excluding VAT; both contracts must have been completed on time, and their start dates must fall within that three-year period. All specialists must be sufficiently proficient in Estonian to perform their duties, or the bidder must provide professional oral and written interpretation at its own expense. The tender documents define professional translation as accurate, complete, clear, consistent and compliant with Estonian language standards. The bid price must follow the structure specified in the evaluation criteria and assessable indicators sheet. The bidder must confirm compliance with the procurement documents; any claimed equivalence must be explained and supported by evidence. Joint bidders must appoint an authorised representative and include the relevant authorisation. The bidder must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation-related numerical figures as trade secrets.
