Compliance requirements
The buyer will exclude a bidder if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; illegally enabling a foreign national to work or breaching the conditions for their employment in Estonia, including paying less than the statutory rate; or unlawful use of child labour or human trafficking. A bidder with outstanding national tax, payment or environmental charges, or tax or social security contribution arrears under the law of its country of establishment, will also be excluded.
The buyer may also exclude a bidder that has seriously or persistently breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty. Exclusion may also apply if the bidder has provided false information about meeting the qualification requirements or failed to provide required information or supporting documents. Companies established in the Russian Federation or the Republic of Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
During the 60 months before the procurement began, the bidder must have properly performed at least three contracts for electrical construction works similar to this contract. At least one contract must have had a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period and the details of the other contracting parties, including the customer representative’s telephone number and email address; for public contracts, include the reference number. At the buyer’s request, the bidder must provide evidence of proper performance, unless the buyer can readily obtain the information from databases.
The bidder’s team must include an employee authorised to carry out switching operations associated with works on 0.22–20 kV electricity networks. That employee must be registered in Elektrilevi’s partner portal before tenders are opened. For works limited to low voltage (0.22–1 kV), low-voltage switching rights are sufficient; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. The team must also include a person responsible for the work operation, registered in the partner portal before the tender submission deadline. The person leading the electrical works must, at the time of tender submission, hold valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act, with supporting evidence, and must be registered in the partner portal before the submission deadline.
The tender must comply with the procurement documents and must not be conditional. The bidder must submit the price table using the form in the procurement documents and complete every unit-price field, taking account of the instructions for completing management-system document V178. The bidder must provide the name, position and contact details of each contract signatory and the contact person for contract matters. If a signatory’s authority is not established by the articles of association, a power of attorney must be included. The bidder must identify and justify any information claimed as a trade secret; the tender price and figures used to assess the award criteria may not be designated as trade secrets.
The buyer’s standard payment periods, counted from receipt of the invoice, are 14 calendar days for contract values up to EUR 59,999; 35 calendar days for values from EUR 60,000 to EUR 249,999; and 45 calendar days for values of EUR 250,000 or more. Participation in the buyer’s factoring programme entails a 95-calendar-day payment period. Materials, equipment and goods used in the works, including components, must not be produced in or originate from Russia or Belarus; the buyer may request certificates of origin. The parsed documents do not specify the award criteria; these must be checked in the procurement documents.
