Compliance requirements
The notice covers exclusion grounds for final convictions within the previous five years involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. It also addresses tax and social security contribution arrears; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement; early termination of previous contracts or comparable sanctions; and false or misleading information, omitted information, failure to provide requested documents or attempts to obtain confidential information. Environmental, social and employment-law breaches, enabling unlawful employment of foreign nationals, international sanctions, and tax offences are also covered. The exclusion ground relating to unlawful employment of foreign nationals is mandatory; the ground concerning tax offences is voluntary. The stated threshold for tax and social security arrears is EUR 0. The notice also explains that an Estonian tax-debt certificate is not issued where the relevant debt, excluding interest not determined by an administrative act, is below EUR 100 or payment has been rescheduled. Where permitted, the tenderer may provide evidence of remedial measures demonstrating restored reliability.
