Compliance requirements
The bidder must declare whether it or its relevant representatives have final convictions within the preceding five years, or are still subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspension of business or similar circumstances; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement where that creates an unavoidable competitive advantage; serious or repeated breach of earlier contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, withholding required information or documents, or improperly obtaining confidential information. Environmental, social and labour-law breaches are also covered. National grounds include enabling the unlawful employment of a foreign national, being subject to an international sanction, and convictions for tax offences. The tax and social-contribution threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued for a debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been rescheduled. Where applicable, the bidder may provide information about measures taken to restore its reliability.
