Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

Mandatory exclusion applies where the bidder, or a person in its management, supervisory or representative bodies, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; enabling unlawful employment or breaches of rules governing the employment of foreign nationals, including payment below the statutory minimum wage; or unlawful child labour or human trafficking. A bidder is also excluded for outstanding public tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an earlier public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to provide such information or requested supporting documents.

Qualification criteria and exclusion grounds

Within the 60 months preceding commencement of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have been worth EUR 80,000 or more, excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties and the contracting authority representative’s contact details, including telephone number and email address; public procurement reference numbers must also be given where applicable. At the contracting authority’s request, evidence of proper performance must be provided unless the authority can obtain it from databases without disproportionate effort. The team must include a worker authorised to carry out switching operations related to the works in a 0.22–20 kV electricity network. This worker must be registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only (0.22–1 kV), low-voltage switching rights are sufficient; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. The team must also include a person appointed as responsible for the work operation, registered in the partner portal before the tender submission deadline. The person directing the electrical works must, at the time of tender submission, hold a valid Class A competence certificate and/or a qualification of at least level 6 under the Vocational Qualifications Act, with supporting evidence. This person must be registered in Elektrilevi’s partner portal before the tender submission deadline. The tender must include a price table in the form provided in the procurement documents, with every unit-price field completed. By submitting a tender, the bidder accepts the procurement-document conditions; conditional tenders or tenders with additional conditions are not permitted. The bidder must provide the name, title and contact details of each contract signatory, as well as the contact details of the person responsible for contract-related matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included. The invoice payment period, counted from receipt by the contracting authority, is 14 calendar days for contracts valued up to EUR 59,999, 35 calendar days for contracts valued from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts valued at EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify and justify any information designated as a trade secret; the price and the evaluation figures specified in the procurement documents may not be designated as trade secrets. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment or goods, including components, originating from or produced in either country may not be installed or used in the works; the contracting authority may request certificates of origin. In a joint tender, the tenderers must submit a power of attorney appointing their representative.
