Compliance requirements
The bidder will be excluded if it, or a person authorised to represent, manage, control or make decisions for it, has been convicted of participation in a criminal organisation, breach of duty of integrity or a corruption offence, fraud, a terrorist offence or related activity, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or violations of the conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; or unlawful use of child labour or human trafficking. A bidder with outstanding state taxes, duties or environmental charges, or tax or social security contribution debts under the law of its country of establishment, will also be excluded.
The contracting authority may also exclude a bidder that has materially or repeatedly breached an important term of a previous public contract, resulting in termination, cancellation, a price reduction, compensation for damage or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to submit required information or additional documents.
Enterprises established or resident in Russia or Belarus are not permitted to participate in the procurement.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have a person responsible for managing electrical works who, by the bid submission deadline, holds valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act. The relevant evidence must be held and the person must be registered in Elektrilevi’s Partner Portal (EPP) before bids are opened.
The bidder must have a worker with valid switching rights for switching operations related to the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in EPP before bids are opened, and the application of switching rights must follow procedure J387. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required. In all other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV).
The bidder must also have a person designated as responsible for the work operation (C-person), registered in EPP before bids are opened. The application of C-person rights must follow documents J31 and J3284.
The bid must include the completed price table in the form provided in the procurement documents, with every unit-price field filled in. Preparation of the bid must also take account of the instructions for management system document V178. The bidder must identify the contract signatory or signatories, their titles and contact details, and a contact person for contract-performance matters. If signing authority does not arise from the articles of association, a power of attorney must be included. Any information claimed as a trade secret must be identified and the claim justified; the price and price components, and other figures or indicators relevant to bid evaluation, may not be designated as trade secrets.
The contracting authority’s standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
Materials, equipment and goods used or installed for the works, including components, must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin. No award criteria are specified in the provided documents.
