Compliance requirements
The bidder must declare whether it or its representatives are affected by grounds for exclusion. These include convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Other grounds include tax or social security payment arrears; insolvency, bankruptcy, liquidation, arrangements with creditors or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement; serious failures under previous contracts; false or misleading information, withholding information, failure to provide requested documents, or attempts to obtain confidential information improperly; and breaches of environmental, social or labour-law obligations. National grounds also cover enabling the unlawful employment of foreign nationals, international sanctions, tax offences, local tax arrears where applicable, and restrictions on the right to submit a tender. The threshold for tax and social security arrears is EUR 0; the notice explains that Estonian tax-debt certificates are not issued for debts below EUR 100 or where payment has been rescheduled. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The financial and technical qualification requirements depend on the lot. In each of the last three financial years completed before the procurement began, the bidder must have had net sales revenue of at least EUR 750,000 for Lot 1 (special and other furniture), EUR 60,000 for Lot 2 (window coverings), or EUR 300,000 for Lot 3 (equipment and tablet systems). If bidding for more than one lot, the applicable turnover thresholds are added together. The bidder must state its turnover for the three years; the contracting authority will check public records and may request extracts from financial statements or other evidence if the information is not publicly available to it.
For Lot 1, the bidder must have properly completed at least two furniture sales contracts during the 36 months before the procurement began, each worth at least EUR 350,000 excluding VAT and including installation, transport and related work. For Lot 2, it must have completed at least one window-coverings sales contract during that period, worth at least EUR 40,000 excluding VAT and including installation, transport and related work. For Lot 3, it must have completed at least one similar contract for equipment for public or communal spaces during that period, worth at least EUR 100,000 excluding VAT and including installation, transport and related work. For supplies under a framework agreement, completed orders placed under the framework may be used as references. Provide descriptions, values, dates and customer details for the contracts.
The tender must comply with the procurement documents and be unconditional. Submit the completed lot-specific pricing form and the total price in euros excluding VAT, to two decimal places; complete every line without changes or unpriced items. Zero or negative prices are not permitted, prices must remain fixed throughout the contract, and external refinancing is prohibited. Submit the completed product specification and product sheets or specifications demonstrating that the goods are new and meet the technical and functional requirements; the permitted dimensional tolerance is ±5% from the example product dimensions unless the specification states otherwise. Explain and provide evidence of equivalence where relevant. For Lot 1, also confirm that the wood is legally sourced and provide evidence of origin upon delivery; declare REACH Candidate List substances present above 0.1% by weight and provide evidence upon delivery; supply disassembly and repair instructions; provide a warranty of at least two years from handover, including repairs and a replacement product during warranty repairs; and ensure spare parts or functionally equivalent components are available for at least two years after handover.
For a joint tender, appoint an authorised representative and include the joint tenderers’ power of attorney. Identify by name and personal identification code any managing or authorised persons not visible in the procurement register, or confirm that there are none. Identify any trade secrets and explain why they qualify; the tender price and other specified figures used for evaluation may not be marked as trade secrets. The bidder must also confirm that the goods are not subject to international sanctions or from sanctioned regions, and that it will not involve the specified Russian persons or entities as subcontractors or suppliers for more than 10% of the contract value.
