Compliance requirements
The bidder must declare whether it or its relevant representatives have applicable grounds for exclusion. These include convictions within the preceding five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an analogous situation, creditor arrangements, court or liquidator administration of assets, or suspended business activity; serious professional misconduct; agreements distorting competition; unmanageable conflicts of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or repeated failure to perform an earlier contract resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procedure or obtain confidential information. National grounds also include enabling a foreign national to work without a legal basis, relevant tax offences, international sanctions, and any applicable restriction on participation based on the bidder’s place of establishment. The bidder may provide information on remedial measures where the law and procurement documents allow this. A bidder must confirm that it will not engage a subcontractor who would have to be replaced under the applicable rules. First-tier subcontractors are checked for applicable exclusion grounds.
