Compliance requirements
The bidder must declare whether it, or a person in its management, supervisory or representative bodies, has been convicted within the relevant period of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The declaration also covers tax or social security payment defaults, breaches of environmental, social or labour obligations, bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration of assets, and suspended business activities.
It must also declare whether it has seriously breached professional conduct rules, entered into agreements intended to distort competition, has an unmanageable conflict of interest, participated in preparing this procurement in a way that creates an unremediable competitive advantage, or had a previous contract terminated early or been subject to damages or comparable sanctions for significant or repeated breach. The grounds further cover false or misleading information, failure to provide required information or documents, attempts to improperly influence the procurement or obtain confidential information, enabling a person without legal grounds to work, and convictions for tax offences. A contract may not be awarded where doing so would breach an applicable international or Estonian government sanction.
For the EU restrictive measures concerning Russia, the bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; entities more than 50% owned directly or indirectly by such persons or entities; or persons or entities acting on their behalf or under their direction. Where a ground applies, the bidder may provide evidence of measures taken to restore its reliability where the applicable rules allow this.
