Compliance requirements
The bidder may be excluded if it, or a member of its administrative, management or supervisory body or a person authorised to represent, decide for or control it, has a final conviction within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include breaches of tax or social security contribution obligations in the country of establishment or the contracting authority’s country. The stated threshold is EUR 0. Under Estonian rules, a tax-debt certificate is not issued if the debt is below EUR 100, excluding interest not established by an administrative act, or if payment has been deferred. Foreign bidders are assessed under the rules of their country of establishment.
A mandatory national ground applies where the bidder or a relevant person has been convicted of enabling a foreign national residing in Estonia without a legal basis to work, or of enabling breaches of the conditions for a foreign national’s employment in Estonia, including payment below the statutory wage rate. A further ground applies where entering into the contract with the bidder would breach an international or Estonian Government-imposed sanction.
