Compliance requirements
The bidder must declare whether it, or any relevant member of its management, supervisory or representative bodies, has a qualifying conviction within the past five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.
Other grounds include failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, asset administration by a liquidator or court, suspended business activity, or a comparable situation; serious professional misconduct; agreements with other businesses intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that gives an unavoidable competitive advantage; serious or repeated failure under an earlier public contract resulting in early termination, damages or comparable sanctions; and false or misleading information, withholding information, failure to provide requested supporting documents, or improper attempts to influence the procurement or obtain confidential information.
National grounds also cover enabling a foreign national to work unlawfully, entering into a contract with a person subject to international sanctions, and conviction for tax offences. The bidder must disclose relevant circumstances and, where applicable, whether outstanding obligations have been settled or a binding payment arrangement made. Estonian tax authorities may not issue a tax-debt certificate for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been rescheduled. Any opportunity to demonstrate restored reliability applies only where permitted by the applicable law or tender documents.
