Compliance requirements
Bidders must declare whether any exclusion grounds apply to them, their representatives or persons in their management or supervisory bodies. The grounds include final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. They also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements intended to distort competition; unresolvable conflicts of interest; involvement in preparing this procurement that creates an unremedied competitive advantage; serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds include enabling the employment of a foreign national without legal grounds, being subject to an international sanction, and certain tax offences. The tender documents provide for the possibility of submitting evidence of measures taken to restore reliability where legally permitted. The notice states a zero threshold for tax and social security debts; Estonian tax-debt evidence is not issued for debt below EUR 100, excluding interest not determined by an administrative act, or where payment has been rescheduled. Foreign bidders' tax-debt evidence is governed by the law of their country of establishment.
Qualification criteria and exclusion grounds
Within the 60 months before the procurement began, the bidder must have duly completed at least two construction contracts for building or reconstructing a public playground, including installation of playground equipment. The playground must have been intended for public or collective use; a playground used only by one household does not qualify. The works must have been completed and handed over to the client within the required period. Joint bidders may meet the experience requirement collectively. If the bidder relies on another entity's experience, that entity must carry out the relevant works. For each reference, provide a description of the works, their time and location, value excluding VAT, the client's name and contact details, and confirmation of proper completion; no minimum contract value applies.
The site manager responsible for the works must hold a level 7 professional qualification as a construction or civil engineering specialist and have at least two reference projects from the previous three years. Submit the site manager's CV with qualification and reference information.
The tender must include product data sheets and evidence of compliance with safety standards for the proposed playground equipment, confirmation of experience installing that equipment with the names of the relevant sites, and a unit-price table showing the scope and cost of the bid. The bid must comply with the procurement documents; conditional bids are not permitted. Any claimed equivalence must be explained and supported with relevant evidence. Joint bids must include an authorisation document. The bidder must confirm that it will not use a subcontractor during contract performance who is subject to mandatory replacement.
Wood used to manufacture furniture must come from legal sources. Evidence of origin, such as FSC certification or a FLEGT or CITES licence, must be provided when the furniture is handed over. Declare any substances on the REACH Candidate List present above 0.1% by weight and, at handover, provide evidence of their presence or absence. Furniture must be dismantlable and repairable using hand tools, with instructions supplied at handover for disassembly and repair without damage. Furniture must carry a warranty of at least two years, and spare parts or functionally equivalent components must be available for at least two years after handover. The supplied documents do not state the award criteria.
