Compliance requirements

The bidder must not be subject to any of the exclusion grounds set out in section 95(1) of the Public Procurement Act. The bid must include confirmation that these grounds do not apply, or information about any applicable circumstance and the measures taken to remedy or rectify it. In a joint tender, each joint bidder must provide the confirmation. The contracting authority will verify the absence of exclusion grounds under the conditions established by law, taking into account, among other things, any period allowed to pay or defer tax arrears and the possibility of remedial measures; the bidder’s confirmation alone is not sufficient. Submission of the European Single Procurement Document is not required.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have duly completed at least two construction contracts for building or reconstructing a public or collective-use playground, including the installation of playground equipment. A playground at an educational institution qualifies, but a playground used only by one household does not. Only work completed and handed over to the client within the required period counts. For contracts performed as a member of a joint tender or as a subcontractor, only the bidder’s own qualifying work is counted; one contract cannot be counted more than once. No minimum contract value applies. For each reference, the bidder must provide a description of the work, its time and location, its value excluding VAT, the client’s name and the contact details of a contact person, and confirmation that the work was completed properly. The information may be provided using the form in Annex C to the tender documents or an equivalent document. The contracting authority may verify the information in public databases and with the client, and may request evidence of proper performance where necessary. Joint bidders may meet the experience requirement together. A bidder may rely on another entity’s technical and professional capacity by providing that entity’s reference details, confirmation concerning exclusion grounds, and written consent or other evidence that the necessary resources will be available. The entity whose experience is relied upon must perform the work for which that experience is required. For a joint tender, a power of attorney for the joint bidders must be submitted. The bid must identify any trade secrets and explain why the information qualifies; the bid price and figures relating to the award criteria may not be designated as trade secrets. The bidder must confirm that it will not use a subcontractor during contract performance who would have to be replaced under the law, and that the bid complies with the tender documents. Conditional bids are not permitted. The bid price must follow the prescribed structure, and Annex B, the price form, must be submitted. If an equivalent solution is offered, the bidder must explain the equivalence and provide supporting evidence.
