Compliance requirements
The bidder will be excluded if the bidder, its representative, a member of its management or supervisory body, or another person controlling the undertaking has been convicted of participation in a criminal organisation, corruption, fraud, terrorism or terrorist financing, money laundering, enabling unlawful employment, human trafficking, or the unlawful use of child labour. Outstanding national taxes, duties or environmental charges, or unpaid tax or social security contributions under the law of the bidder’s country of establishment, are also grounds for exclusion.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached material terms of a previous public contract, resulting in termination or withdrawal, a price reduction, compensation for damage or a contractual penalty. A bidder may likewise be excluded for providing false information or failing to provide required information or documents.
Undertakings established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three electrical construction contracts similar to the subject of this procurement. At least one contract must have been worth at least EUR 40,000 excluding VAT. The bidder must provide a list stating the performance period, the client representative’s contact details (including telephone number and email address), and procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper completion must be provided unless the authority can obtain the information from databases without significant expense.
The bidder’s team must include a worker with the switching authorisations required for the works, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only (0.22–1 kV), low-voltage switching authorisation is sufficient. In all other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage work requires switching on the medium-voltage side. The team must also include a person designated as responsible for the work operation, registered in the same portal before the tender submission deadline.
The person directing the electrical work must, at the time of tender submission, hold a valid A-level competence and/or a qualification of at least level 6 under the Occupational Qualifications Act, supported by evidence. This person must be registered in Elektrilevi’s partner portal before the tender submission deadline.
The tender must comply with the procurement documents; conditional tenders and tenders containing additional conditions are not permitted. The bidder must submit the price table in the prescribed format and complete every unit-price field. The bidder must provide the name, job title and contact details of the contract signatory or signatories, as well as the contact person for contract-performance matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included.
The bidder must identify any information in the tender claimed as a trade secret and explain the basis for that designation, or state that the tender contains no trade secrets. The tender price and figures used to assess the award criteria may not be designated as trade secrets.
The invoice payment period, running from receipt of the invoice, is 14 calendar days for contracts worth up to EUR 59,999, 35 calendar days for contracts worth EUR 60,000–249,999, and 45 calendar days for contracts worth EUR 250,000 or more. Participation in the contracting authority’s factoring programme extends the payment period to 95 calendar days.
Materials, equipment, goods and components originating in or produced in Russia or Belarus may not be installed or used during the works. The contracting authority may request certificates of origin as evidence.
