Compliance requirements

A bidder will be excluded if the bidder, a member of its administrative, management or supervisory body, or another person authorised to represent or control the bidder or make decisions on its behalf has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or another terrorism-related offence, money laundering or terrorist financing. Grounds for exclusion also include convictions for enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions for a foreign national’s employment in Estonia, including paying less than the required wage, as well as unlawful use of child labour or an offence related to human trafficking. Tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment, are also grounds for exclusion. The contracting authority may exclude a bidder for a substantial or repeated breach of an important term of a previous public contract where this resulted in termination or cancellation, a price reduction, compensation for damage or a contractual penalty. Exclusion may also apply if the bidder provided false information about meeting the qualification requirements or failed to submit required information or documents. Under the tender conditions, an undertaking established or resident in the Russian Federation or the Republic of Belarus may not participate.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have a value of EUR 50,000 or more, excluding VAT. The bidder must provide a list of the contracts showing their performance periods, details of the other contracting parties (including the customer representative’s telephone number and email address), and, for public contracts, the reference number. The contracting authority may request evidence of proper performance. The team must include a worker with the switching rights required for the works, registered in Elektrilevi’s partner portal before the tenders are opened. For 0.22–1 kV works, at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the over-1–20 kV side. The team must also include a person responsible for the work operation, registered in the partner portal before the tender submission deadline, and a person leading the electrical works who holds valid A-level competence and/or a qualification at level 6 or higher, with the relevant proof. The electrical works lead must also be registered in the portal before the submission deadline. The tender must include a price table using the required form, with every unit-price field completed; conditional tenders are not permitted. The bidder must provide the name, job title and contact details of each contract signatory and of the contact person for contract performance. If a signatory’s authority is not based on the articles of association, a power of attorney must be included. In a joint tender, the bidders must appoint an authorised representative and provide a power of attorney. The bidder must identify and justify any trade secrets in its tender; prices and indicators relating to the award criteria cannot be treated as trade secrets. The invoice payment period depends on the contract value: 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment, goods or components originating from or manufactured in Russia or Belarus may not be installed or used; the contracting authority may request certificates of origin as evidence.
