Compliance requirements
The buyer will exclude a bidder if the bidder, or a person authorised to represent, manage, supervise or control it, has been convicted of offences relating to participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism, money laundering or terrorist financing; enabling unlawful employment of a foreign national or breaches of rules on foreign nationals’ employment in Estonia, including underpayment; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, levy or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction. These grounds apply to all lots. The bidder must confirm that none of these grounds apply and that it has reviewed the buyer’s rules and guidance published on its website.
Qualification criteria and exclusion grounds
For Lots 1–3, a bidder that is not the manufacturer of the tyres offered must submit a copy of the manufacturer’s original authorisation to market the tyres in Estonia.
The bid must not be conditional and must comply with the tender documents. For each lot, the bidder must provide internet links to technical information about the tyres and confirm delivery within 30 calendar days of the buyer’s order. The tyres must be manufactured by members of ETRMA (the European Tyre & Rubber Manufacturers’ Association).
For Lot 1 (underground loader truck tyres) and Lot 3 (front-end loader tyres), the bidder must provide a prescribed confirmation of a warranty of at least 3,000 mh. For Lot 2 (grader tyres), the required mileage warranty is at least 50,000 km, confirmed in the prescribed form. For Lot 1, the supplier must replace at its own expense tyres that fail before the warranty period ends, except where failure results from a puncture or cut; failures caused by overheating are not accepted.
