Compliance requirements
The bidder must confirm that neither it nor its representatives have been convicted by a final court judgment within the past five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of child labour, or human trafficking. The bidder must also have no outstanding tax or social security contribution debt. The ESPD sets the relevant debt threshold at EUR 0, subject to the stated exception for tax debts below EUR 100 or debts covered by a payment schedule.
Other possible grounds for exclusion include bankruptcy, insolvency or liquidation proceedings, assets administered by a liquidator or court, suspension of business activities, an arrangement with creditors, serious professional misconduct, agreements distorting competition, conflicts of interest, involvement in preparing the procurement where this creates an undue advantage, material or repeated breaches of previous contracts, and submitting false or misleading information, withholding required information or documents, or improperly obtaining confidential information. Grounds also include breaches of environmental, social or labour-law obligations; enabling a foreign national staying in Estonia without a lawful basis to work or paying less than the required wage; being subject to an international sanction; and conviction for a tax offence.
