Compliance requirements
A bidder may be excluded if, within the preceding five years or while an exclusion period set by a judgment remains in force, the bidder or a relevant person connected with it has received a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of human trafficking. Where permitted by law, the bidder may provide evidence of measures taken to restore its reliability.
Other grounds include failure to pay taxes or social security contributions; bankruptcy, insolvency, liquidation or comparable situations; an agreement with creditors; suspended business activity; serious professional misconduct; agreements or conduct that distort competition; an unmanageable conflict of interest; improper involvement in preparing the procurement; significant or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information. Grounds also include breaches of applicable environmental, social or labour obligations, enabling the unlawful employment of a foreign national, being subject to an international sanction, and convictions for tax offences. The tax-debt threshold is stated as EUR 0; the notice explains that the tax authority does not issue a debt certificate where the relevant debt is below EUR 100 or payment has been rescheduled. These grounds apply to all lots. Any available reliability-restoration measures are subject to the stated legal conditions.
Qualification criteria and exclusion grounds
For each lot, the bidder must have properly completed at least 2 contracts for the sale of similar goods during the 36 months before the procurement began. Each contract must be worth at least EUR 100,000 excluding VAT. Similar goods are thermal, wool, mesh or sports underwear, and other garments intended for use as underwear or a base layer. The bidder must list the contracts, including their value, dates, counterparties and a description of the goods supplied. Before the contract is signed, the successful bidder must provide supporting evidence, such as customer confirmations or handover and acceptance certificates. If relying on another entity’s capacity, the bidder must provide the relevant information and confirmations for that entity as well.
The bid must include product information and material specifications sufficient to demonstrate compliance with the technical descriptions, and information showing how the offered models’ sizes correspond to the buyer’s size table. The material must meet EVS-EN ISO 6330:2021 or an equivalent standard; evidence such as test reports, manufacturing certificates, EN certificates or declarations of conformity must be submitted with the bid. Any claimed equivalence must be explained and supported by evidence.
Product samples in size L (104/180) are required for each relevant lot: for mesh underwear, one long-sleeved shirt, one short-sleeved shirt and one pair of long trousers; for wool underwear, one long-sleeved shirt and one pair of long trousers. Samples must be delivered to Pärnu mnt 139, 15060 Tallinn, packaged and labelled as specified in the tender documents, and the buyer’s contact person must be notified in advance. Missing, late or non-compliant samples result in rejection of the bid. The bidder bears the cost of the samples and their transport.
The bid must follow the required price structure and may not be conditional. Joint bidders must appoint an authorised representative and include the required power of attorney. The bidder must provide the required confirmations concerning applicable sanctions, including restrictions on certain subcontractors and suppliers and confirmation that the offered goods are not subject to international sanctions. The parsed documents do not specify the award-scoring details; check the official tender documents.
