The bidder must confirm that neither it nor its representatives are subject to any exclusion grounds. The checks cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism and terrorist financing, money laundering, child labour or human trafficking, and other serious offences. Exclusion may also result from tax or social security arrears, bankruptcy or other insolvency or liquidation proceedings, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, a conflict of interest or involvement in preparing the procurement. Previous serious or repeated breaches of public contracts, false statements, failure to provide required information or documents, and improper influence over the decision-making process are also covered. The bidder must also confirm that no exclusion grounds arise under national law, including enabling the employment of a foreign national without a legal basis, breaching international sanctions or being convicted of tax offences. Where permitted by the applicable rules, the bidder may provide evidence of measures taken to restore its reliability.

The bidder must have previous experience in the manufacture and/or sale of military individual equipment, winter outdoor equipment, mountain equipment or other similar tactical equipment. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least one comparable product supply contract or order for at least one European Union Member State or candidate country, with a value of at least EUR 100,000. The bidder must provide the reference description, value, performance period, contracting authority and contact details, as well as its area of responsibility. The bidder must submit a properly completed compliance matrix and bid submission form. For each product offered, it must state whether the product is being offered and provide the unit price and delivery time in calendar days. The bidder may choose how many product categories to offer. The bid must comply with the tender documents; conditional bids are not permitted. Where relevant, an explanation and evidence of equivalence must be provided. The required contact and bank details must be submitted with the bid. In the case of a joint bid, a power of attorney for the joint bidders must be included. The machine-readable notice does not specify a separate financial capacity or turnover requirement.
