The bidder must confirm that none of the mandatory exclusion grounds apply to it or to relevant persons authorised to represent, manage or control it. These grounds include convictions for participation in a criminal organisation, breaches of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, child labour or human trafficking; outstanding tax, social security contribution or environmental charge debts; and circumstances in which awarding the contract would breach an international or Estonian government sanction. A bidder may also be excluded if it is not entitled to participate under the national restrictions on the bidder’s place of establishment set out in the procurement documents.

Qualification criteria and exclusion grounds

The bidder must hold a food handling permit or have notified the Agriculture and Food Board of its activity and be registered for food handling in the catering field. The bidder must hold this permit or registration itself; joint bidders may rely on one another’s financial or other indicators where permitted, but not to meet this requirement. The bidder’s average annual net turnover over the last three completed financial years must be at least EUR 100,000. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens or residents, are established in Russia, are more than 50% directly or indirectly owned by such persons or entities, or act on their behalf or under their instructions. It must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. A joint bid must identify an authorised representative and include the joint bidders’ power of attorney. The bid must not be conditional. It must include a one-week sample menu meeting the technical specification, with menu descriptions, portion sizes and calorie content, and the completed fields in Annex 2, “Sample menu and unit prices”. Prices must follow the structure specified in the pricing schedule. Any information claimed as a trade secret must be identified and the claim justified; prices and other specified evaluation-related figures may not be treated as trade secrets. The notice does not state the award criteria or their weighting.
