Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must be excluded if it, or a person authorised to represent, make decisions for or control it, has been convicted of participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to enabling unlawful employment or breaches of the conditions for employing foreign nationals, including paying less than the statutory minimum wage; or unlawful use of child labour or human trafficking. Exclusion is also mandatory for outstanding national taxes, duties or environmental charges, or unpaid taxes or social security contributions under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or persistently breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction work similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have had a value of at least EUR 80,000 excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties’ details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant expense. The bidder must have an electrical works manager with valid A-level competence and/or a qualification of at least level 6 under the Professions Act. The person must hold the relevant evidence by the bid submission date and be registered in Elektrilevi’s Partner Portal before the bids are opened. The bidder must have a worker authorised to perform switching operations related to the works in the 0.22–20 kV electricity network, excluding regional and distribution substations, and that worker must be registered in the Partner Portal before the bids are opened. For low-voltage works only (0.22–1 kV), low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). Applications for switching rights must follow the training procedure in document J387. The bidder must also have a person responsible for the work operation, registered in the Partner Portal before bids are opened; the rules in documents J31 and J3284 apply when obtaining that person’s rights. The bid must include the price in the prescribed table, with every unit-price field completed, and must comply with the tender documents; conditional bids or bids with additional conditions are not permitted. The bidder must take account of the completion instructions in control-system document V178. The bidder must provide the name, position and contact details of each contract signatory and a contact person for contract matters. If signing authority does not arise from the articles of association, a power of attorney must be included. The standard payment period from receipt of the invoice is 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days from receipt of the invoice. The bidder must identify and justify any business secrets in its bid. The bid price and item prices, as well as other figures or indicators used to evaluate bids, may not be designated as business secrets. The bidder must confirm that its place of residence or registered office is not in the Russian Federation or the Republic of Belarus. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from either country; the contracting authority may request certificates of origin.
