Compliance requirements

The bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent or control it or make decisions on its behalf, has been convicted of participation in a criminal organisation, breach of professional integrity, a corrupt act, fraud, a terrorist offence or a related offence, money laundering, or terrorist financing. Exclusion also applies to convictions for enabling the employment of a foreign national staying in the country unlawfully or violating the conditions for a foreign national’s employment in Estonia, including payment below the statutory wage rate, and for the unlawful use of child labour or human trafficking. A bidder with outstanding national taxes, charges or environmental fees, or tax or social security contributions due under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to provide that information or requested supplementary documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement; at least one contract must have been worth €40,000 or more excluding VAT. Provide a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the reference number. The contracting authority may request evidence of proper performance unless it can obtain the information from a database without significant cost. The bidder must have a worker authorised to carry out switching operations related to the works on the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in Elektrilevi’s partner portal before tenders are opened. For works involving only low voltage (0.22–1 kV), at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The applicable training procedure is set out in document J387. The bidder must have a person appointed as responsible for the work operation, registered in the partner portal before tenders are opened. The procedures for obtaining this status are set out in documents J31 and J3284. The bidder must also have a person managing electrical works with a valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. That person must hold the relevant evidence when tenders are submitted and be registered in the partner portal before tenders are opened. Submit the price using the prescribed table and complete every unit-price field. Preparation of the tender must take account of the instructions for completing management system document V178. Conditional tenders or tenders containing additional conditions are not permitted. Provide the contract signatory’s name, position and contact details, the basis for their signing authority, and the contact person’s details for contract matters; include a power of attorney if the authority does not arise from the articles of association. The contracting authority’s standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to €59,999, 35 calendar days for contracts from €60,000 to €249,999, and 45 calendar days for contracts of €250,000 or more. Participation in the authority’s factoring programme results in a 95-calendar-day payment period. Identify any trade secrets in the tender and explain why they qualify; alternatively, state that the tender contains no trade secrets. Tender prices and other specified figures or indicators used in evaluation may not be designated as trade secrets. The bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from either country; the contracting authority may request certificates of origin.
