Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The exclusion grounds cover final convictions within the previous five years of the bidder or persons authorised to represent, manage or control it for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. They also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or similar situations; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest; involvement in preparing the procurement that creates an unremovable advantage; and serious or repeated failures under previous public contracts resulting in early termination, damages or comparable sanctions. Grounds also include false or misleading information, failure to provide required information or documents, improper attempts to influence the procurement or obtain confidential information, enabling unauthorised foreign nationals to work, international sanctions, tax offences, and any applicable restriction on the bidder's country of establishment. For Estonian tax debts, the notice states that a certificate is not issued where the relevant debt is under EUR 100 or payment has been deferred. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder's net turnover for the most recent financial year completed by the start of the procurement must be at least EUR 3,500,000. Joint bidders may aggregate their turnover. The bidder provides turnover details in the ESPD and, if requested, an extract from its annual report or other evidence unless the information is publicly available to the contracting authority. If relying on another entity's turnover, the bidder must provide that entity's details and, on request, its consent; the entity is jointly liable with the bidder for the contract part supported by its turnover. Within the 60 months before the procurement began, the bidder must have duly completed at least one contract for construction works on a publicly used road that included laying at least 15,400 m² of asphalt-concrete surface course. Contract details must be provided in the ESPD. If requested, the bidder must submit the client's confirmation that the works were properly completed, including the contract period and information on the area of surface course laid. If relying on another entity's technical capacity, the bidder must provide its details and, if requested, its consent confirming the capacity made available and its direct participation in performing at least the part of the contract for which that capacity is relied upon. The bid must confirm acceptance of the contract notice and tender-document conditions and cover all matters for which the contracting authority requested competing bids. The bidder must confirm that it will not involve a subcontractor who must be replaced under the law. The bid must include the completed extended-warranty-period table in the prescribed Excel format and a project implementation plan; the plan is one of the bid evaluation bases. For a joint bid, submit a power of attorney appointing the joint representative and a separate ESPD for each joint bidder. Provide the names and personal identification codes of persons authorised to represent, make decisions for or control the bidder if they are not shown in the commercial register, or confirm that there are no such persons. Identify and justify any trade secrets in the bid; the bid price and figures responding to evaluation criteria may not be classified as trade secrets. The bidder must also confirm that any goods offered are not subject to international sanctions and do not originate from sanctioned regions.
