Compliance requirements
The tender passport asks the bidder to declare whether, within the last five years or for any period of exclusion still in force, the bidder or its relevant representatives have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. It also covers breaches of tax and social security payment obligations, enabling a foreign national to work without a legal basis or in breach of applicable employment conditions, and whether awarding the contract would breach international or Estonian government sanctions. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability. The document notes that the Estonian tax authority does not issue a tax-debt certificate where the relevant tax debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been deferred; foreign bidders are subject to the rules of their country of establishment.
