Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The tender passport asks the bidder to declare whether, within the last five years or for any period of exclusion still in force, the bidder or its relevant representatives have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. It also covers breaches of tax and social security payment obligations, enabling a foreign national to work without a legal basis or in breach of applicable employment conditions, and whether awarding the contract would breach international or Estonian government sanctions. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability. The document notes that the Estonian tax authority does not issue a tax-debt certificate where the relevant tax debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been deferred; foreign bidders are subject to the rules of their country of establishment.

Qualification criteria and exclusion grounds

The tender passport does not specify concrete qualification criteria or turnover, experience or team requirements. The bid must be prepared using the buyer’s Price Form in Annex 1 and submitted in the structure provided on the award-criteria and evaluated-indicators sheet; the price stated on that sheet takes precedence over any price stated elsewhere in the bid. If offering an equivalent product, the bidder must include evidence and an explanation of equivalence with the bid. During contract performance, the bidder must supply the product offered and may not replace it later. The bidder must identify any information claimed as a trade secret and justify that designation. The bid price and item prices may not be treated as trade secrets, nor may other bid indicators corresponding to the evaluation criteria for a works contract. The bidder must confirm that it will not engage a subcontractor who would be subject to replacement and that the bid complies with the tender documents. Conditional bids are not permitted.
