Compliance requirements
The bidder may be excluded for relevant final convictions within the previous five years involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include unpaid taxes or social-security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where the resulting advantage cannot otherwise be prevented; and serious or persistent failures under previous contracts resulting in early termination, damages or comparable sanctions.
A bidder may also be excluded for submitting false information, withholding required information or documents, improperly influencing the procurement or seeking confidential information to gain an unfair advantage. National grounds include enabling the unlawful employment of a foreign national, being subject to an applicable international sanction, tax offences, relevant local tax debt where provided for, and restrictions on eligibility based on the bidder’s place of establishment. Where the applicable rules allow it, the bidder may present evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
For all five lots, the bidder must have completed at least three contracts during the 36 months preceding the start of the procurement. Each contract must be worth at least EUR 50,000 excluding VAT and cover year-round outdoor cleaning of an area, including pavement, road and parking-area cleaning, anti-icing and snow clearance, lawn mowing, and maintenance pruning of trees and/or shrubs. The bidder must provide a list of contracts with their values, dates and other contracting parties.
The bidder must provide at least one site manager/contact person for contract delivery. This person must have managed at least two comparable public-procurement sites where the specified outdoor maintenance tasks were carried out; a comparable site has an area of at least 4,500 m². Submit a document describing the site manager’s experience.
The bid price must follow the structure specified in the tender pricing schedule. Zero and negative prices are not permitted. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must identify any trade secrets in the bid and explain why the information qualifies, but may not classify the bid price or price components, or other numerical evaluation information, as confidential. The bidder must also confirm that it will not use a subcontractor that is subject to replacement under the applicable procurement rules. Where applicable, the bidder must confirm that Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value and that the contract is not prohibited by international sanctions.
