Compliance requirements
The tender passport asks the bidder to declare whether the bidder or its representatives have relevant convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. It also covers unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or similar situations; suspension of business; serious professional misconduct; agreements with other businesses to distort competition; conflicts of interest or involvement in preparing the procurement that cannot otherwise be addressed; and serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions.
The bidder must also declare whether it has breached environmental, social or labour-law obligations; submitted false or misleading information, withheld required information or documents, or improperly sought confidential information; enabled unlawful employment of a foreign national; or been convicted of tax offences. A contract may not be awarded where doing so would breach international or Estonian sanctions. Where the applicable rules allow it, a bidder subject to an exclusion ground may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one contract during the 36 months before the procurement began for the sale or rental of series-produced electric bicycles used in a public bike-sharing system. The reference must concern a system installed in public space and open to the public. Provide details of the contract, including its value, dates and client. At the contracting authority’s request, submit the client’s confirmation that the contract was performed as agreed; the tender documents ask bidders to include this confirmation with the tender, unless the client was Tartu City Government. No specific turnover or other financial-capacity threshold is stated in the available requirements.
The tender must include the completed technical compliance table (Appendix 5), a description and drawings of the proposed bicycle showing at least its dimensions, accessories, weight, design and advertising options, and a description of its technical solution, including the electrical system, charging, brakes and locking system. Submit user, maintenance and repair manuals covering all bicycle components, including the motor and battery. The price must follow the structure specified in the tender documents. Confirm that the tender meets the requirements; explain any claimed equivalence and provide supporting evidence where needed. For a joint tender, appoint an authorised representative and include the power of attorney. Identify any trade secrets and explain why they qualify, but do not mark the price or other specified evaluation figures as trade secrets.
The offered bicycles must be compatible with the existing bike-sharing infrastructure and IT system, including the management software. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers with the specified Russian citizenship, residency, establishment, ownership or representation links.
