Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder and relevant representatives must not be subject to exclusion grounds including convictions within the applicable period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, comparable proceedings, administration of assets by a liquidator or court, or suspended business activity; and serious professional misconduct. Other grounds include agreements intended to distort competition, an unmanageable conflict of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, or serious or persistent breaches of a previous public contract resulting in early termination, damages, a price reduction or a contractual penalty. Exclusion may also follow from false or misleading information, failure to provide required information or documents, attempts to improperly influence the contracting authority or obtain confidential information, international sanctions, enabling a foreign national without lawful grounds to work, and any applicable restrictions on the bidder’s place of establishment. The contracting authority may also apply the stated national grounds concerning local tax debt or convictions for tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

For both lots, the bidder must be an insurer authorised to conduct insurance activities or an insurance intermediary entitled to provide insurance services in Estonia. An insurer must hold the required authorisation, operate through an established branch, or have notified the Estonian Financial Supervision Authority of its cross-border insurance services. An intermediary must be registered in the Authority’s register of market participants. The bidder may offer only insurance types covered by its authorisation or registration. The contracting authority will check the publicly available register; if the bidder’s details are not listed there, it must submit copies of documents proving compliance. The offer must follow the prescribed pricing structure and include the completed Excel forms: the vehicle lists and price forms for motor liability and comprehensive insurance for Lot 1, and the machinery insurance list and price form for Lot 2. Enter the one-month premiums for the listed vehicles or machinery and provide prices in euros, excluding VAT, to two decimal places. Do not alter or delete the contracting authority’s lists, names or other supplied data. If prices entered in the register differ from those in the price forms, the prices in the forms will prevail. The offer must also include the general insurance terms and the relevant motor liability and comprehensive insurance terms for Lot 1, or machinery insurance terms for Lot 2, and confirm acceptance of the procurement documents’ conditions. The bidder must identify any authorised representatives not visible to the contracting authority in the commercial register, providing their names and personal identification codes, or confirm that there are no such persons. A branch of a foreign company must also submit the parent company’s European Single Procurement Document. Joint bidders must appoint an authorised representative and provide the prescribed power of attorney. The bidder must identify and justify any claimed trade secrets; prices and other specified evaluation-related figures may not be designated as trade secrets. The bidder must confirm that neither it nor persons acting on its behalf have engaged in corruption in this procedure, and that subcontractors and suppliers used in contract performance are established in Estonia, another EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement. No precise award-scoring formula is stated in the supplied documents.
