Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for final convictions within the last five years, or an exclusion period that remains in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. These grounds may apply to the bidder or its management, supervisory or representative persons. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. Exclusion grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements or conduct distorting competition; conflicts of interest that cannot otherwise be remedied; involvement in preparing this procurement where an advantage cannot otherwise be neutralised; significant or repeated breach of a previous contract resulting in termination, damages, a price reduction or a penalty; and false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. National grounds include enabling a foreign national without a lawful basis to work, being subject to an international sanction, and conviction for tax offences. The bidder must also confirm that the contract would not breach international or Estonian sanctions.

Qualification criteria and exclusion grounds

The bidder’s net turnover over the last three completed financial years must total at least EUR 200,000. If the information is not available in a public database, the contracting authority may request the bidder’s annual accounts for those three years or extracts from them. During the five years preceding publication of the contract notice, the bidder must have completed at least one construction contract as main contractor, with construction works worth at least EUR 50,000 excluding VAT. The reference must concern one of these building types: a care institution, dormitory, accommodation, catering, office, commercial, service, entertainment, museum or library, educational or research, hospital, or sports building. The bidder must provide details of the contract value, completion dates, other contracting party and its contact person, building type, and the bidder’s responsibility for organising and managing the works as a whole and coordinating the different trades. Further evidence may be requested to verify the information. The bidder must submit the completed price table in the required format and a completed, signed specialists’ table. For framework agreement assignments, the bidder must be able to provide specialists with the competencies specified for design work and for construction and reconstruction work in the technical description. The bidder must also submit a table of subcontractors known when the tender is submitted, or an empty table if none are known. Where the bid is submitted jointly, the joint bidders must appoint an authorised representative and provide the required power of attorney. The bidder must visit the site before the tender deadline and provide the signed attendance record. Registration for the visit is required at least three working days beforehand; the site is at Järveküla tee 75, Kohtla-Järve. The bid must meet the procurement documents and must not be conditional. Any claimed equivalence must be explained and supported by evidence. The bidder must identify and justify any trade secrets, but may not classify the tender price or specified price-evaluation figures as trade secrets. The framework agreement is to be awarded to at least two compliant bidders and may include up to six bidders, based on the lowest-priced bid for the first site described in the technical specification.
