Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if the bidder or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, corruption or breach of integrity, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking. The grounds also cover enabling the unlawful employment of a foreign national or breaching the conditions for employing foreign nationals in Estonia, including paying below the statutory wage rate. A bidder with outstanding tax, payment or environmental-charge debts, or social security contribution debts under the applicable national law, may be excluded. A bidder that is subject to an international or Estonian government sanction may not be awarded the contract. The contracting authority may also exclude a bidder for serious or repeated breaches of previous public contracts that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about qualification or failing to provide required information or evidence. The bidder must confirm that no applicable exclusion grounds exist and provide relevant details if a ground applies; the documents also ask whether measures have been taken to demonstrate reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 500,000 in each of the last three completed financial years. Where the bidder relies on another entity’s financial capacity, that entity must provide a digitally signed commitment confirming that the resources are available throughout the framework agreement; the bidder and that entity are jointly liable for the relevant contract part. Within the 60 months preceding publication of the contract notice, the bidder must have completed at least three electrical construction contracts for a network operator within the meaning of the Electricity Market Act. Their combined value must be at least EUR 500,000 excluding VAT. Submit the completed Form 3 listing the contracts, their values, dates and counterparties, and, where available, their procurement register references; include written confirmations of proper performance from the counterparties where required. Within the 36 months preceding publication of the contract notice, the bidder must have prepared and handed over to a network operator at least 10 compliant external electricity network construction designs. The designs must have been completed on time, with no contractual penalties or compensation paid in connection with their performance. Submit the completed Form 4 with brief descriptions, handover dates, counterparties and, where available, procurement register references. The bidder must provide the completed Form 5 naming personnel with the required valid authorisations. If any named person is not the bidder’s employee, submit an agreement or preliminary agreement for that person’s services. Personnel performing the specified low-voltage live work must hold valid authorisations for the listed tasks; provide certificate copies if they are not already available in Elektrilevi’s partner portal. The tasks include work in low-voltage switchboards, connecting a concentrator power cable in a substation, connecting or disconnecting a branch on an overhead line, and replacing a pole. At least one named person must hold a valid electrical A-competence certificate or an equivalent electrical engineer qualification. Bidders established outside Estonia must provide evidence of that person’s corresponding competence. The minimum numbers and further requirements for personnel and machinery are set out in Annex 1; the supplied text does not state those figures. Submit the completed Form 1 price schedule. Provide unit prices for the listed works, except for the works in section 6, for which the buyer has set base prices and the bidder must offer a coefficient. The total bid price is the sum of all work prices and must be stated in euros excluding VAT. Complete all bidder-designated fields; do not alter the listed items or quantities. Conditional bids are not permitted, and submission confirms acceptance of the tender-document requirements. For a joint bid, appoint an authorised representative and submit the Form 2 power of attorney. If trade secrets are claimed, identify the information and explain why it qualifies; prices and specified evaluation-related figures may not be treated as trade secrets. The bidder must also confirm that it will not use materials, equipment or goods, including components, produced in or originating from Russia or Belarus; origin certificates may be requested. The supplied text does not specify the award criteria; check the official tender documents for them.
