Compliance requirements
The bidder must confirm that no mandatory exclusion ground applies. These include convictions of the bidder or relevant managers, representatives or controllers for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking, and enabling unlawful employment of a foreign national or breaches of conditions for foreign nationals working in Estonia. Outstanding taxes, payments or environmental charges, and being subject to an international or Government of Estonia sanction, are also grounds for exclusion.
The contracting authority may also exclude a bidder for serious or repeated breaches of previous public contracts that resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about qualification or failing to submit required information or documents. Companies established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 500,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing turnover, unless the information is publicly available to the contracting authority in a register. At least six months must have elapsed between the end of the latest completed financial year and the bid submission date. If the bidder relies on another entity’s financial resources, both entities are jointly liable for the contract part concerned. The supporting entity must provide a digitally signed confirmation that the resources are available and will remain available throughout the framework agreement.
During the 60 months preceding publication of the contract notice, the bidder must have completed at least three electrical construction contracts for a network operator within the meaning of the Electricity Market Act. Their combined value must be at least EUR 500,000 excluding VAT. Submit a list stating the values, contract dates and counterparties, using Form 3, and written confirmation of proper performance from the other contracting party where applicable.
During the 36 months preceding publication of the contract notice, the bidder must have prepared and delivered to a network operator at least 10 compliant external electrical network construction projects. Projects must have been completed on time, without contractual penalties or compensation for damages. Submit the project list with brief descriptions, delivery dates and counterparties using Form 4.
For the bid to comply, complete the price schedule (Form 1) in euros excluding VAT, including all fields designated for the bidder. Do not change any item or quantity. Quote unit prices for the listed work, except for the design and contracts items, for which the buyer sets base prices and the bidder quotes a coefficient. Joint bidders must appoint an authorised representative and submit the power of attorney using Form 2.
Provide the names of the personnel with the required valid authorisations in Form 5. The minimum personnel and machinery requirements are set out in Annex 1. If listed personnel are not the bidder’s employees, provide an agreement for their use in performing the contract. Provide copies of certificates for low-voltage live-work personnel if the valid certificates are not already available in Elektrilevi’s partner portal. The bidder must also have at least one person holding a valid A-category electrical competency certificate or equivalent electrical engineer qualification; bidders established outside Estonia must provide evidence of that qualification.
Price is the only award criterion.
