Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of duty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences concerning the unlawful employment of foreign nationals or breaches of their employment conditions; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, payment or environmental charges, or tax or social security contributions due under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction. A foreign-established bidder must submit evidence with its tender showing that the grounds concerning convictions and tax or social security debts do not apply. This includes a criminal record extract or equivalent document from a competent authority and a certificate confirming that no relevant debts are outstanding. The sanctions ground is checked on the basis of the bidder’s confirmation. If the relevant documents are not issued or do not cover all matters, an equivalent declaration or other permitted evidence must be provided. The contracting authority may request further information or evidence where it has justified doubts. The bidder must also disclose known circumstances that may indicate a conflict of interest on the contracting authority’s side or an advantage over other bidders arising from involvement in preparing the procurement or another connection with the contracting authority. If such circumstances exist, the bidder must explain the person involved, the nature of the connection and the information received or other relevant facts.

Qualification criteria and exclusion grounds

The bidder and each joint bidder must be registered in the commercial register or an equivalent register in its country of establishment, where registration is required. A foreign bidder must provide a valid registration certificate or equivalent document. The bidder, or an undertaking whose resources it relies on, must have properly completed at least one contract during the 60 months preceding the start of the procurement procedure for developing and/or deploying an automated monitoring, control or detection system operating in an industrial environment on a continuously moving bulk-material flow. The material must have moved at a speed of at least 1.0 m/s, and the system must have analysed particle or lump size and/or automatically detected oversized particles or lumps. The bidder must provide a contract list stating the contract name, client, performance period, work description, bulk material type, material transport method and speed, system function, and the client contact person’s details. If relying on another undertaking’s experience, that undertaking must be identified in the register and must perform the part of the contract for which that experience is required. The bidder must have access to at least the following qualified specialists for contract performance: an automation and electrical design specialist holding a Class B competence certificate with design rights, or a level 6 electrical engineer qualification with design competence, or an equivalent or higher qualification; and a person responsible for directing electrical work on equipment up to 1,000 V, holding at least a Class B competence certificate or an equivalent professional certificate authorising that work. One person may fill multiple roles if their qualifications meet the requirements for each role. The bidder must provide a list of responsible specialists and copies of documents proving their qualifications and competence. For qualifications obtained abroad, the bidder must provide supporting documents and, where required, ensure recognition of the qualification or notification for temporary service provision before the relevant work begins. The tender must include a detailed description of the proposed technology covering its operating principle, system configuration, equipment and models, equipment location on the conveyor and in the gallery, and any auxiliary equipment affecting material flow, including justification of its safety. The bidder must also provide evidence that the technology detects oversized particles throughout the depth of the material layer, not only on its surface, and that its performance has been demonstrated at an operational reference installation. Evidence may include a test report, confirmation from the reference installation’s client, photographs or video, or other relevant evidence. Evidence must also support the declared detection accuracy and false alarm rate; exact numerical values are not stated here. A phased work schedule must be provided, including the approximate total period for which the conveyors will need to be stopped. The tender must include a CRA compliance declaration or a commitment to provide it upon delivery; evidence of compliance with IEC 62443-4-1 and IEC 62443-4-2 or equivalent documented evidence; a description of the vulnerability management process; a commitment to provide a software bill of materials (SBOM) upon delivery; the end-of-life and end-of-support dates and lifecycle support periods for supplied components; and deadlines for supplying critical security updates. The exact numerical values of these deadlines are not stated. The price must be submitted in the prescribed structure using the electronic pricing form and the completed “Form V2. Price Proposal”; the Annex 2 information table must also be provided. Conditional tenders are not permitted, and submission confirms acceptance of the tender document conditions. If awarded the contract, the bidder must sign and return it within 7 calendar days of receipt. Joint bidders must appoint an authorised representative and include a power of attorney. Subcontracting is permitted; if subcontractors are used, the bidder must provide a list stating each subcontractor’s task and share of the subcontracted work. The bidder must disclose any known circumstances that may create a conflict of interest or competitive advantage and provide explanations where necessary. The materials provided do not specify the award criteria.
