Compliance requirements

A bidder may be excluded for final convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Grounds also include breaches of tax or social security payment obligations; violations of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, court-appointed administration of assets or suspension of business; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; significant or repeated failures under previous contracts resulting in termination, price reduction, compensation or penalties; false or misleading information, omitted information or failure to provide requested documents; and attempts to improperly influence the procedure or obtain confidential information. National grounds also cover enabling a foreign national to work unlawfully, international sanctions and convictions for tax offences. For tax debts in Estonia, the stated threshold is EUR 0; the notice explains that a tax debt certificate is not issued for debts below EUR 100, excluding interest not established by an administrative act, or where payment has been deferred. A bidder may provide evidence of remedial measures where permitted by law or the procurement documents.

Qualification criteria and exclusion grounds

The requirements apply to the specified lots as follows: - For Lot 1, the bidder must have properly performed at least 3 building maintenance service contracts during the 36 months preceding the procurement’s start date. Each building must have a gross internal area of at least 1,000 m². - For Lots 2 and 3, the bidder must have properly performed at least 3 such contracts during the same 36-month period, each for a building with a gross internal area of at least 4,000 m². The buyer may also consider experience older than 36 months where needed to ensure adequate competition. - For each reference contract, provide a client confirmation or other evidence acceptable to the contracting authority showing the contract name and period, service location and scope, whether performance was satisfactory, any breaches or penalties, and, where applicable, their nature, extent and resolution. The references concern regular, fixed-scope maintenance of buildings, structures and building systems under EVS 807:2024, excluding specialist maintenance of systems such as electrical installations, ventilation, heating and lifts. - For all lots, maintain professional liability insurance of at least EUR 200,000 throughout the contract. - For all lots, appoint a site supervisor with at least Estonian Qualifications Framework level 5 real estate maintenance supervisor qualification or an equivalent qualification. The supervisor must be available on site in Tartu as needed to ensure proper performance and act as the contractor’s representative and the client’s contact person. Staff performing maintenance at the sites must hold at least level 3 real estate maintenance worker qualification, a higher level 4 or 5 qualification, or an equivalent qualification. Provide the qualification certificates for all identified persons. The document lists two level 3-or-higher maintenance workers. The bid must comply with the procurement documents; conditional bids are not permitted. Submit the price using the prescribed structure. Explain any claimed equivalence and provide supporting evidence. In a joint bid, include the joint bidders’ power of attorney. Identify any trade secrets and justify that designation; bid prices and applicable evaluation figures may not be classified as trade secrets. The notice does not state the award scoring criteria.
