Compliance requirements
The bidder must declare whether it or its representatives have relevant final convictions within the previous five years, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Declarations are also required concerning tax and social security contribution arrears; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, administration of assets or suspended business; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; early termination or sanctions under previous contracts; false or misleading information, failure to provide required information or documents, and improper attempts to obtain confidential information.
Grounds under Estonian law also include enabling an unlawfully present foreign national to work or breaching the conditions for employing a foreign national, being subject to an international or Estonian government sanctions measure that would make the contract unlawful, tax-related offences, and any restriction on participation based on the bidder’s country of establishment or residence set out in the tender documents. For tax and social security arrears, the notice states a threshold of EUR 0; it also notes that a tax-debt certificate is not issued for debts below EUR 100, excluding interest not determined by an administrative act, or where payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder and each member of a joint tender must be registered in a commercial or equivalent register in their country of establishment. If registration is not legally required, the bidder must provide a copy of its founding document or an equivalent document. The bidder must hold any licence or registration required to provide the service and, if the relevant information is not publicly available, provide supporting evidence. Bidders established outside Estonia must provide evidence from the competent authority in their country of establishment confirming their right to operate in this field, or a copy of the relevant licence or registration.
The bid must include the application declaration in the required format, with a validity period of at least three months. Joint bidders must appoint an authorised representative and provide the original power of attorney; a separate power of attorney is also required if the person signing the bid or contract is not listed as authorised to represent the legal entity in the register.
The proposed insurance cover must fully comply with the Mandatory Liability Insurance of Healthcare Providers Act and the minimum technical requirements in the tender documents. The premium must include the full cost of the claims-reporting period, with no additional payment obligation for the hospital relating to that period when the policy ends or the insurer changes. The bidder must submit the proposed insurance terms. The premium must be quoted annually and paid by monthly invoices. The insurer must be ready to issue the policy no later than three working days before the insurance period begins.
The insurer must have a claims-handling department, representative or cooperation partner that healthcare providers and entitled persons can contact in Estonian at a contact point in Estonia. The bid must include confirmation of this arrangement and the relevant contact details; if a cooperation partner is used, its written confirmation of participation in the claims-handling process is required. The price must follow the structure specified in the tender documents. The bidder must identify and justify any information it claims as a trade secret; the price and other figures relevant to evaluating the bid may not be designated as trade secrets. No award criteria or scoring details are specified in the provided documents.
