Compliance requirements

The bidder must confirm that neither it nor its relevant representatives have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences or related conduct, money laundering, terrorist financing, unlawful employment of foreign nationals or violations of conditions for their employment, unlawful child labour or human trafficking. A bidder with outstanding state tax, duty or environmental charge debts, or tax or social security contribution arrears under the law of its country of establishment, is subject to exclusion. A bidder must also be excluded if awarding the contract would breach an international or Estonian government sanction. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals or residents, established in Russia, more than 50% directly or indirectly owned by such persons or entities, or act as their representatives or on their instructions. An offer may be rejected if the resulting contract would be void under the applicable sanctions rules.

Qualification criteria and exclusion grounds

The bidder must be registered as an insurance broker in the Estonian Financial Supervision Authority’s register of insurance intermediaries, or hold an equivalent registration under the law of its country of establishment. A foreign bidder must provide evidence of registration; the contracting authority will check the registration of bidders established in Estonia. The bidder’s combined net turnover from insurance brokerage services over the last three financial years completed by the start of the procurement must be at least EUR 1,000,000 excluding VAT. The bidder must provide the turnover information using the required form. The bidder must hold valid mandatory liability insurance with a limit of at least EUR 10 million per claim throughout the service period and provide evidence of the policy. If the policy held when the bid is submitted expires before the service period ends, submission of the bid confirms that the bidder will extend the insurance on at least equivalent terms. The bid must include a team list and CVs showing that: - At least one team member has energy-sector experience, within the 60 months before the procurement began, on a contract involving assets worth at least EUR 50 million per contract. - At least one key person who will directly perform the contract has personally participated in arranging an insurance programme covering property, machinery breakdown and/or business interruption for at least one major electricity or heat generation asset and at least one renewable energy asset. - The risk-survey provider’s CV lists, in separate tables, heat and/or electricity company clients (including renewable energy) for which the provider carried out risk surveys during the 60 months before the procurement began. The list must include at least one energy asset insured for more than EUR 50 million for which a risk-survey report was submitted to insurers. - The claims-handling specialist has handled at least one property, machinery breakdown or business interruption claim involving a production asset, where the claim submitted to the insurer was at least EUR 500,000 and the specialist participated in coordination and negotiations. The bidder must also provide a list of claims settled with the requested compensation during the 60 months before the procurement began, involving production-site property damage and/or business interruption and exceeding EUR 500,000. At least one team member who will directly perform the framework agreement must have been involved in those claims. Key personnel must perform the roles stated in the bid; replacement requires the contracting authority’s prior written consent and a person with equivalent experience. The bidder must confirm that it can serve clients in Estonia, Latvia and Lithuania and provide day-to-day customer service in Estonian and English. The offer must comply with the procurement documents, use the prescribed pricing structure and not be conditional. For a joint bid, the bidders must appoint an authorised representative and include the required power of attorney. The bidder must submit the required team list, CVs, claims list, turnover information and insurance evidence, and explain any claimed equivalence with supporting evidence where applicable.
