Compliance requirements
The bidder and relevant persons authorised to represent, manage or control it must not be subject to applicable exclusion grounds. These include relevant criminal convictions; unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or suspended business activities; breaches of environmental, social or labour obligations; serious professional misconduct; agreements restricting competition; conflicts of interest or involvement in preparing this procurement where these cannot be remedied; serious failures under previous contracts; false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the procedure. The notice also addresses unlawful employment of foreign nationals and tax offences under national law, as well as international sanctions. Participation is not permitted for businesses, including entities whose capacities are relied upon, established or resident in Russia or Belarus. The bidder must confirm that it will not use subcontractors or suppliers covered by the specified Russian-related sanctions for more than 10% of the contract value. The bidder must also provide names and personal identification codes for relevant authorised persons of the bidder and subcontractors who are not identifiable from the commercial register, or confirm that there are no such persons.
Qualification criteria and exclusion grounds
The bidder must have access to a veterinary professional holding a valid authorisation from the Agriculture and Food Board to provide veterinary treatment and prophylaxis, either as its own specialist or under a contract or preliminary contract. The specialist will organise veterinary work at the shelter and be responsible for its veterinary situation. The bidder must provide the specialist’s CV details in the ESPD. The contracting authority will verify the authorisation against the Board’s public information. The bidder must also have, or be able to use, the tools and equipment needed for the contract: a vehicle for transporting animals and access to a backup vehicle, a mobile phone, a computer with a permanent internet connection, and animal-catching equipment, boxes and traps. Submit a detailed equipment list in the ESPD or as a free-form document; if the equipment is not owned by the bidder, include its owner’s consent to make it available. The bidder must describe its technological competence and service quality assurance measures, including sustainable delivery methods and the information required by point 7 of Annex 1, the Technical Description. Submit the completed Annex 4 declaration and bidder confirmations, the Annex 3 price offer using the prescribed structure, and the required service description. Conditional tenders are not allowed. If relying on another entity’s capacity, provide that entity’s ESPD and signed consent using Annex 5; the entity must undertake to participate directly in the relevant contract work, accept joint responsibility for the part relying on its technical or professional capacity, and confirm that it is not subject to the specified exclusion grounds. Joint bidders must appoint an authorised representative and submit the relevant power of attorney.
