Compliance requirements
A bidder must be excluded if it or a relevant member of its administrative, management or supervisory body, authorised representative or controller has been convicted of the specified serious offences, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, unlawful employment of foreign nationals, child labour or human trafficking. Exclusion is also mandatory for outstanding tax, social security or environmental payment debts, or applicable international sanctions, subject to the stated legal exception. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency or similar circumstances; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest or advantages arising from involvement in preparing the procurement; significant or persistent failure to perform previous public contracts; false or missing qualification information; attempts to improperly influence the contracting authority or obtain confidential information; certain tax offences; or lack of the legal right to submit a bid. The bidder must confirm that neither the mandatory nor the stated discretionary exclusion grounds apply. Companies established in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 100,000 in each of the three most recently completed financial years. Submit extracts from the annual accounts showing turnover for those years, unless the information for an Estonian-registered legal entity is publicly available to the contracting authority. If the financial year does not coincide with the calendar year, the requirement applies to the three most recently completed financial years; at least six months must have passed since the end of the most recently completed financial year by the bid submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the contract subject matter. At least one must have a value of EUR 80,000 or more excluding VAT. Provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. Evidence of proper completion must be provided if requested, unless the contracting authority can obtain it from databases without significant cost.
Before bids are opened, the bidder must have in Elektrilevi’s partner portal (EPP) a worker authorised to carry out the required switching operations on 0.22–20 kV networks, except at regional and distribution substations; a person appointed as responsible for the work operation; and a person leading electrical works with valid A-level competence and/or a qualification of at least level 6 under the Professional Qualifications Act. The bidder must confirm these requirements and provide the required evidence of the electrical works lead’s qualification. The bid must include the prescribed price table with every unit-price field completed and must accept the tender-document conditions without additions or qualifications. Provide the contract signatory’s details and proof of authority where that authority does not arise from the articles of association, and name a contact person for contract performance. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
