Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded for final convictions within the previous five years, or for an exclusion period that is still in force, involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include breaches of tax or social-security payment obligations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; and serious or repeated breaches of earlier contracts resulting in early termination, damages, price reductions or penalties. Exclusion may also follow from false or misleading information, failure to provide required information or documents, or attempts to influence the procurement or obtain confidential information improperly. National grounds include enabling the unlawful employment of a foreign national, entering into a contract that would breach international sanctions, and convictions for tax offences. The notice identifies the unlawful-employment ground as mandatory and the tax-offence ground as voluntary. For tax and social-security arrears, the stated threshold is EUR 0; under Estonian rules, however, a tax-debt certificate is not issued where the relevant arrears are below EUR 100 or payment has been deferred. Where permitted for this procurement, a bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must confirm that its tender complies with all procurement-document requirements; conditional tenders are not permitted. The bidder must provide the name, role, telephone number and email address of both the person who would sign the framework and procurement contracts if awarded and the contact person for contract performance. The signatory’s authority must be stated and, where applicable, a power of attorney must be included. For a joint tender, a power of attorney for the joint bidders is required. From handover of the device until the end of the framework agreement, the bidder must provide one medical equipment specialist who has received manufacturer training to maintain and repair the offered device and whose working language is Estonian. The bidder must provide the specialist’s details and the manufacturer’s confirmation of the training. The bidder must be the manufacturer’s official representative and provide the manufacturer’s confirmation of its representation and sales rights. The tender must include the offered product’s declaration of conformity; catalogues for the device and all accessories; manufacturer information; operating and maintenance instructions; technical data; or other relevant documents proving compliance with the technical requirements. All blank fields in the technical specification and consumables offer form must be completed, and Annex I must be submitted. Pricing must follow the structure in the evaluation criteria and priced indicators worksheet. The bidder must confirm that it will not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia; are owned, directly or indirectly, by such persons or entities by more than 50%; or act on their behalf or under their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The tender must identify any information claimed as a trade secret and explain that designation. Prices and figures relating to the evaluation criteria may not be classified as trade secrets. The machine-readable documents do not specify a separate turnover, previous-experience or other financial-capacity threshold, or a detailed scoring system.
