Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1), points 1–3 and 5, of the Estonian Public Procurement Act, taking account of Section 95(2), apply. The bidder must also confirm that it is not bankrupt, being liquidated, subject to bankruptcy or liquidation proceedings, or otherwise in a comparable situation, and that it has no outstanding national tax, duty, environmental charge, or tax or social security contribution debts under the law of its country of establishment. The bidder must confirm that its employees’ average salary during the six-calendar-month reference period was more than 70% of the sector average for the same period; this must be evidenced by a tax authority extract or, for a foreign bidder, equivalent evidence from the competent authority. In a joint tender, each joint bidder must provide the relevant confirmation and salary evidence. The bidder must also confirm that it is not a related party of the technical consultant advising the beneficiary on the apartment building’s reconstruction. The beneficiary checks exclusion grounds for the successful bidder, including each joint bidder.

Qualification criteria and exclusion grounds

The bidder must be registered in the Estonian Register of Economic Activities for construction, covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical work, it must also be registered for construction and installation of electrical installations. Foreign bidders are exempt from the Estonian registration requirement but must provide equivalent evidence of competence where applicable. The bidder’s net turnover in the financial year preceding commencement of the procurement must be at least twice the contract’s estimated value excluding VAT (2025 if the bidder’s financial year is the calendar year). By the contract signing date, or within 10 calendar days after signing at the latest, the bidder must be able to provide a performance-period guarantee equal to 5% of the contract value, valid throughout the construction period. An equivalent deposit into the beneficiary’s or notary’s account is acceptable, provided the beneficiary remains the entitled party throughout the construction period; joint bidders may meet this requirement together. During the 60 months before publication of the procurement, the bidder must have completed at least one comparable construction project as main contractor, with a value of at least half the estimated contract value excluding VAT. The project must have involved construction, extension or full-building reconstruction and included structural and external-envelope works, heat-recovery mechanical ventilation, and a new or reconstructed heating system. Completion must be evidenced by an acceptance certificate signed by the client and contractor or by a reference to the building register’s notice of use or occupancy permit. The bidder must provide the project details, dates, value and scope. The team must include a project manager with at least the specified level 6 building-construction or general construction management qualification; a site manager with at least the specified level 5 general construction qualification; a ventilation and heating systems specialist with the specified level 6 qualification; and a water supply and sewerage systems specialist with the specified level 6 qualification. For electrical work, a person with at least a Class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations is required. Equivalent foreign qualifications are accepted. These personnel must participate in the works, and their names and certificate or qualification numbers must be provided. The bidder must operate construction-sector quality and environmental management systems meeting at least EVS-EN ISO 9001 and EVS-EN ISO 14001, respectively, or equivalent standards. The bid must use the beneficiary’s pricing form and include all costs in the total price. Conditional bids are not permitted. The bid must be submitted by a legal or authorised representative; evidence of authorisation must be included where required. Joint bidders must provide a power of attorney specifying each party’s share and role and are jointly and severally liable. Any proposed equivalence must be explained and supported by evidence. Written consent must be provided for each proposed team member who is not an employee of the bidder or a joint bidder.
