Compliance requirements

The bidder must not be subject to mandatory exclusion grounds. These include convictions of the bidder or relevant representatives, managers, supervisory-body members, procurists or controlling persons for participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving illegal employment or unlawful employment conditions for foreign nationals, including payment below the statutory wage rate; or illegal child labour or human trafficking. The bidder must also have no outstanding state tax, duty or environmental-charge debt, or tax or social-security contribution debt under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required qualification information or additional documents. Companies established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from Russia or Belarus may not be installed or used; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and the procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be provided unless the information can be obtained from public or private databases without significant expense. The bidder must have a person responsible for electrical works who holds a valid A competency certificate and/or a qualification of at least level 6 under the Qualifications Act. The person must hold the required evidence by the tender submission deadline and must be registered in the EPP environment before the tenders are opened. The bidder must also have a person responsible for the work operation with valid rights, who must be registered in the EPP environment before the tenders are opened. The tender must include Form 2 containing technical information on surge arresters in a 10 kV network and Form 1, the price offer table. All unit-price fields in the price table must be completed. The bidder must provide the signatory’s authority, the signatory’s name, position and contact details, and the contact person’s details for contract-performance matters. A power of attorney must be attached if the signatory’s authority does not arise from the articles of association. The bidder must accept the procurement-document requirements without conditions or additional terms and must select the applicable standard payment term. The standard payment terms are 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for a value of EUR 60,000–249,999, and 45 calendar days for a value of EUR 250,000 or more; participation in the contracting authority’s factoring programme results in a 95-calendar-day payment term.
