Compliance requirements
The bidder must confirm that neither the company nor its directors, managers, supervisory board members, authorised representatives or persons controlling the company have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the illegal employment of third-country nationals and other human trafficking-related offences. The bidder must also have no outstanding tax or social security payment obligations. Entering into the contract must not breach international or Estonian sanctions, including the applicable restrictions concerning sanctioned Russian persons and entities. Where an exclusion ground exists, the bidder may provide evidence of remedial measures where this is legally permitted or provided for in the procurement documents. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable public procurement rules.
Qualification criteria and exclusion grounds
The requirement applies to both Lot 1, the sauna house design and construction, and Lot 2, the auxiliary building design and construction. The bidder's annual net turnover must have been at least EUR 150,000 in each of the last three financial years. If the bidder has operated for less than three years, the average turnover for the period of operation is used. Within the 60 months preceding the publication of the contract notice, the bidder must have properly completed at least two similar construction contracts. Each reference must involve the bidder acting as the main contractor, construction of a building, part of a building or building complex with at least 70 m² of enclosed net floor area, and construction, extension or full reconstruction works. Both reference projects must have load-bearing timber structures, and at least one must use handcrafted logs. The bidder must submit a list of the projects with client contact details, a description demonstrating compliance, the enclosed net floor area and the contract period; a public procurement reference number must also be provided where applicable. The client may request confirmation that the works were properly completed. The designer or designers must hold the relevant professional qualification, including at least a Level 7 Chartered Structural Engineer qualification for structural works. The contractor must involve at least one site manager with relevant education or qualification and provide information about the nominated persons; supporting education or qualification documents must be submitted at the contracting authority's request. The bid must follow the prescribed price-sheet structure, use the corrected price form for the relevant lot and be unconditional. The bidder must provide a minimum 24-month warranty from final acceptance, repair or replace defects at its own cost and provide the maximum response or completion period for warranty works. A joint bid must include a power of attorney for the authorised representative. The bidder must identify and justify any trade secrets, but may not classify the bid price or other prohibited price-related figures as trade secrets.
