Procurement of Rental, Transport and Handling Services for Containers for Ordinary and Hazardous Waste

The bidder will be excluded if any mandatory or applicable discretionary exclusion ground under Section 95(1), Section 95(4) point 8 or Section 95(4 prim) of the Estonian Public Procurement Act applies. The bidder must confirm that none of these grounds exists. The grounds include final convictions within the relevant period, or an ongoing exclusion obligation, involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. They also include breaches of tax or social security payment obligations, including the contracting authority’s applicable local tax arrears, as well as serious or persistent breaches of previous public contracts that resulted in early termination, compensation, a price reduction, a contractual penalty or comparable sanctions. Where applicable, the bidder may be required to provide details of the decision, the person concerned, the exclusion period, available electronic evidence and any remedial measures demonstrating reliability.

The tender is divided into two parts. For Part 1, the bidder must hold valid authorisation throughout the contract period for transporting and handling ordinary waste: a waste handler registration, waste management environmental permit or integrated environmental permit. The bidder must also hold an environmental permit or another legal basis covering the hazardous waste types, activities and treatment sites required for contract performance. For Part 2, the bidder must hold an environmental permit or another legal basis covering the hazardous waste types, activities and treatment sites required for transporting and handling waste oil. The bidder must provide the relevant registration or permit numbers; the contracting authority will verify the permits in the Environmental Board’s public register. For both parts, the bidder must have professional liability insurance of at least EUR 50,000 per insured event during the insurance period. The cover must include damage caused to the contracting authority and/or third parties by the bidder or its subcontractors. A valid insurance certificate or equivalent evidence must be submitted. For each part, the bidder must have the vehicles necessary to provide the service, including a tanker truck where needed for pumping liquid waste. The vehicles must meet at least the EURO VI emissions standard or an equivalent standard. The tender must include the required price forms: RHAD Form 2 for Part 1 and RHAD Form 3 for Part 2, completed according to the structure specified in the pricing worksheet. If the amounts differ, the amount in the relevant RHAD form prevails. If subcontractors are used, they must be identified and RHAD Form 4 must be submitted. Joint bidders must appoint an authorised representative, submit the power of attorney on RHAD Form 1, provide exclusion-ground confirmations for all joint bidders, and describe each bidder’s share and role in the contract. The offer must be unconditional, comply with the procurement documents and framework agreement draft, be submitted by a lawful or authorised representative, and include the required sanctions and business-secret declarations.
