Compliance requirements
The bidder, its management, supervisory board members, procurist or other authorised representatives must not have been convicted of participation in a criminal organisation, breach of duty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, or offences involving child labour or human trafficking. The bidder must not have outstanding national, local or environmental tax debts, or unpaid tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or that has provided false information or failed to submit required information or additional documents. Participation is not permitted for undertakings established or resident in the Russian Federation or the Republic of Belarus. The bidder must confirm that these exclusion grounds do not apply.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the commencement of the procedure. At least one of these contracts must have had a value of EUR 40,000 or more, excluding VAT. A list of the contracts must be submitted, including the performance period, the contracting party's representative and contact details, and procurement reference numbers where applicable. Evidence of proper performance must be submitted at the contracting authority's request, unless the information can be obtained from public or private databases without significant expense.
The team must include a person with valid switching rights for the required operations in a 0.22–20 kV electricity network and registered in Elektrilevi's partner portal before the tenders are opened. For works involving only low-voltage operations, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights may be required, including where low-voltage works require switching on the medium-voltage side. The bidder must also have a person responsible for the work operation, registered in the partner portal before the tender submission deadline, and a person leading electrical works with valid A-level competence and/or a qualification corresponding to at least level 6 under the Qualifications Act. The latter must hold the relevant proof at the time of submission and be registered in the partner portal before the deadline.
The tender must comply with all procurement documents; conditional or additional terms are not permitted. The price must be submitted using the required price table and all unit-price fields must be completed. The bidder must provide the names, positions and contact details of the authorised contract signatory or signatories and a contract-performance contact person; a power of attorney is required if the signing authority does not arise from the articles of association. The standard payment period is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority's factoring programme results in a 95-calendar-day payment period. The bidder must identify and justify any trade secrets; the tender price and other prohibited evaluation-related figures may not be classified as trade secrets. Materials, equipment, goods and components used in the works must not be produced in or originate from Russia or Belarus, and certificates of origin may be requested.
