Compliance requirements
A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, an authorised signatory, or another person with powers of representation or control, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, or related offences. Exclusion also applies to offences involving the unlawful employment of a foreign national staying in Estonia or the payment of wages below the statutory rate, as well as unlawful child labour or trafficking in human beings. The bidder must not have outstanding taxes, public charges or environmental charges in Estonia or in its country of establishment.
The contracting authority may also exclude a bidder for a substantial or repeated breach of an earlier public contract if this resulted in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from providing false information about compliance with the qualification requirements or failing to submit required information or documents. The bidder must confirm that none of these exclusion grounds applies.
Companies established or residing in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the telephone number and email address of the client’s representative, and the reference numbers for public contracts. The contracting authority may request evidence that the contracts were properly performed.
The team must include an employee with valid switching authorisations for work-related switching operations in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline.
The person leading the electrical works must, when the tender is submitted, hold a valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Qualifications Act, together with the relevant evidence, and must be registered in Elektrilevi’s partner portal before the deadline.
The tender must include the completed pricing table and comply with all tender document requirements. Conditional tenders and tenders containing additional conditions are not permitted. The bidder must provide the details of the contract signatory and contact person; if the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bidder must identify and justify any trade secrets or confirm that the tender contains none. The tender price and other numerical indicators used for evaluation may not be classified as trade secrets. Materials, equipment, goods or components originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin.
