The bidder must confirm that none of the applicable exclusion grounds applies to the bidder, its management or supervisory body members, representatives, authorised decision-makers or controllers. These grounds include final convictions within the last five years or an ongoing exclusion period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal use of child labour or other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations. The notice addresses insolvency, bankruptcy, liquidation, agreements with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, early termination or sanctions under previous public contracts, false or omitted information, failure to submit requested documents, attempts to obtain confidential information or improperly influence the contracting authority, and breaches of environmental, social or labour law obligations. The bidder must also confirm that the applicable national exclusion grounds do not apply, including unlawful employment of foreign nationals, being subject to international sanctions, and relevant convictions for tax offences. Where an exclusion ground applies, the bidder may provide information and evidence of measures taken to restore its reliability if permitted by the applicable rules.

The bidder must be entered in the relevant commercial register in its country of establishment and must provide the registration details or supporting evidence when requested. The bidder must have the capacity to perform all required maintenance, warranty and repair work at a service point accepted or authorised by the vehicle manufacturer. The bidder must have access to make-specific passenger-car maintenance and repair centres in Tallinn. The bidder must identify the relevant technical personnel or technical unit and provide information on their qualifications and experience. If the information is not available through public registers, the bidder must submit appropriate supporting evidence upon request. The offer must comply with all procurement documents and may not be conditional. The bidder must submit the price in the required structure, provide the requested offer-price data using the prescribed form, and identify and justify any trade secrets. A joint offer must include the authorisation of the joint bidders’ representative. The bidder must submit a copy of the offered vehicle’s type approval, with an Estonian translation where necessary. At the start of the operating lease, the present value of the minimum lease payments must not exceed 90% of the leased asset’s fair value, and the lease term must not cover more than 75% of the asset’s economic life. The bidder must also confirm that the ownership and control-related requirements concerning the Russian Federation and/or Belarus are met, including the requirement that more than 50% of the bidder is not directly or indirectly owned by specified Russian persons or entities and that the bidder does not act under their instructions.
