Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives are subject to any applicable exclusion grounds. These include, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour and human trafficking. The bidder must also have no outstanding tax or social security payment debt, bankruptcy, liquidation or other insolvency proceedings, suspended business activities, serious professional misconduct, anti-competitive agreements, unavoidable conflict of interest or material breaches of previous public contracts. The bidder must also confirm that it has not submitted false information, has provided the required information and documents, and that awarding the contract would not breach sanctions or other national exclusion grounds under section 95 of the Estonian Public Procurement Act. Tax and social security obligations must be fulfilled or covered by a binding payment arrangement. The required declaration and, where applicable, evidence must be provided in the ESPD, and the contracting authority may request additional evidence.
