Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives are subject to any applicable exclusion grounds. These include, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour and human trafficking. The bidder must also have no outstanding tax or social security payment debt, bankruptcy, liquidation or other insolvency proceedings, suspended business activities, serious professional misconduct, anti-competitive agreements, unavoidable conflict of interest or material breaches of previous public contracts. The bidder must also confirm that it has not submitted false information, has provided the required information and documents, and that awarding the contract would not breach sanctions or other national exclusion grounds under section 95 of the Estonian Public Procurement Act. Tax and social security obligations must be fulfilled or covered by a binding payment arrangement. The required declaration and, where applicable, evidence must be provided in the ESPD, and the contracting authority may request additional evidence.

Qualification criteria and exclusion grounds

The machine-readable ESPD did not specify separate requirements concerning the bidder’s financial capacity, turnover, previous experience, personnel or professional certificates. Under the compliance requirements, the bidder must submit an unconditional tender and confirm that it complies with all conditions set out in the tender documents. Conditional tenders are not allowed. If the tender is submitted by a consortium, the consortium members must appoint an authorised representative from among themselves and attach a power of attorney to the tender. All information and documents required by the tender documents must be submitted with the tender; the detailed technical and other tender requirements must be checked in the tender documents.
