Preparation of the initial positions for Anija municipality’s special planning for a wind farm and the programme for the strategic environmental impact assessment

The bidder must confirm that neither it nor its management, administrative or supervisory body members or other relevant representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal use of child labour or human trafficking. The bidder must also have no outstanding tax or social security payment obligations. The bidder must confirm that it has not breached environmental, social or labour-law obligations, is not bankrupt, being liquidated or otherwise insolvent, does not have assets administered by a liquidator or court, and has not suspended its business activities. Possible grounds for exclusion also include serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement in a way that distorts competition, serious breaches of previous procurement contracts, and the submission of false information or failure to provide required documents. The bidder must also confirm that no national exclusion grounds apply, including enabling an unlawfully residing foreign national to work, breaches of international or Estonian sanctions, local tax arrears owed in the contracting authority’s location, convictions for tax offences, or restrictions on participation in public procurement. Under the tender conditions, the bidder’s registered office or residence must not be in the Russian Federation or the Republic of Belarus.

The bidder must have sufficient competence and experience to prepare the initial positions for Anija municipality’s special planning for a wind farm and the programme for the strategic environmental impact assessment. - The lead SEA expert must hold a valid environmental impact assessment licence under Sections 14–15 of the Environmental Impact Assessment and Environmental Management System Act, or equivalent competence authorising the expert to lead the SEA of plans. The bid must include the expert’s first and last name and the licence code or number. - During the last five years, the lead expert must have led at least one SEA or EIA for a wind energy development, or the preparation of an SEA for a local government or national special plan. The bidder must identify the relevant project details. - The team must include a spatial planning expert or planner with a master’s degree, or equivalent education, in geography, architecture or landscape architecture, or a level 7 planner qualification. The planner’s first and last name and qualification details must be provided. - The bidder must provide the names of the persons assigned to perform the contract, together with evidence of their competence or licences and a description of their experience. The lead expert named in the bid must be used during contract performance. Replacement requires the contracting authority’s consent, and the replacement must meet the same requirements. - If persons representing the bidder, including subcontractors, are not visible to the contracting authority in the commercial register or another relevant register, their names and personal identification codes must be provided, or the bidder must confirm that no such persons exist. - The bid must comply with the procurement documents and follow the required pricing structure. Conditional bids are not permitted. In the case of a joint bid, a power of attorney for the joint bidders must be submitted. - During contract performance, the bidder may use only subcontractors and suppliers whose registered office or residence is in Estonia, another European Union Member State, another European Economic Area contracting state, or a country that is party to the World Trade Organization Government Procurement Agreement.
