Compliance requirements

The bidder may be excluded if the bidder, a member of its administrative, management or supervisory body, its procurist or another person authorised to represent, control or make decisions for the bidder has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies where such persons have been convicted of enabling an unlawfully residing foreign national to work or of breaching the conditions for employing a foreign national, including paying less than the statutory remuneration; of illegal use of child labour or trafficking in human beings; or where the bidder has outstanding state tax, payment or environmental charges, or tax or social security contribution arrears under the law of its country of establishment. The bidder may also be excluded where awarding the contract would violate an international sanction or a sanction imposed by the Government of the Republic. The bidder must confirm that none of these exclusion grounds applies. The bidder must notify the contracting authority of circumstances that may indicate a conflict of interest or distortion of competition, including involvement in preparing the procurement or another relationship with the contracting authority that may have provided an advantage. If applicable, the bidder must submit a free-form explanation with the tender or the European Single Procurement Document.

Qualification criteria and exclusion grounds

The bidder and/or its subcontractor must have properly completed at least one contract during the 36 months preceding the commencement of the procurement for electrical measurements and/or auditing at an industrial or production facility, or involving a high-voltage or industrial electrical installation. The bidder must submit a list of the relevant contracts completed during that period, including dates and the other contracting parties, using the required contract list form. The contractor must be accredited as an inspection body for auditing electrical installations in accordance with Estonian standard EVS-EN ISO/IEC 17020. A copy of the valid accreditation certificate and its annex specifying the scope of accreditation must be submitted with the tender. The bidder and/or its subcontractor must have qualified persons responsible for performing the works. The person responsible for managing the electrical works must hold at least an A-class competence certificate or an equivalent or higher qualification. Copies of documents proving the person’s qualifications and competence must be submitted. A foreign bidder without documents issued under Estonian regulations must submit equivalent documents issued under the law of its country of establishment and confirm that it will obtain confirmation of the responsible person’s qualification and competence from the Consumer Protection and Technical Regulatory Authority within one month after signing the contract. By submitting a tender, the bidder confirms that it accepts all conditions in the procurement documents. Conditional tenders are not permitted. The bidder must also confirm the absence of known circumstances indicating a conflict of interest or an unfair competitive advantage; if such circumstances exist, a free-form explanation identifying the relevant person, relationship and information obtained must be submitted with the tender or the European Single Procurement Document.
