Compliance requirements
A bidder must be excluded if it or a person with authority to represent, manage or control it has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, child labour or human trafficking. Exclusion also applies where the bidder has outstanding taxes, social security contributions or environmental charges, or is subject to an international sanction, unless awarding the contract would not breach that sanction. The contracting authority may also exclude bidders for breaches of environmental, social or labour obligations; insolvency or similar circumstances; serious professional misconduct; agreements or conduct that distort competition; an unmanageable conflict of interest or an unfair advantage arising from involvement in preparing the procurement; significant or repeated failures under previous public contracts; false or misleading information or failure to provide requested evidence; attempts to improperly influence the contracting authority or obtain confidential information; tax-related convictions; or lack of the legal right to submit a bid.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. It must provide extracts from the annual accounts showing turnover; this is not required from an Estonian-registered legal entity if the information is publicly available to the contracting authority. At least six months must have passed since the end of the most recently completed financial year by the bid submission date.
During the 60 months before the procurement began, the bidder must have properly completed at least three contracts for electrical construction works similar to this contract. At least one must have had a value of EUR 80,000 or more excluding VAT. Submit a list showing each contract’s performance period, the other contracting party’s details, including a contact person’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The team must include a person leading the electrical works who, by the bid submission deadline, holds valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act, holds evidence of that qualification, and is registered in Elektrilevi’s Partner Portal. The bidder must also have an employee with valid switching rights for the relevant 0.22–20 kV network operations, registered in the portal before bids are opened. For low-voltage-only works (0.22–1 kV), at least low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The team must also include a person responsible for the work operation, registered in the portal before the bid submission deadline.
Submit the price table using the provided form and fill in every unit-price field. The bid must accept all procurement-document conditions; conditional or qualified bids are not permitted. Provide the contract signatory’s name, title and contact details, the contract-performance contact’s details, and proof of signing authority where it does not follow from the articles of association. Joint bidders must appoint an authorised representative and provide the relevant authorisation. The bidder must confirm that its registered or residential location is not in Russia or Belarus and that materials, equipment and goods used for the works, including components, are not produced in or sourced from either country; origin certificates may be requested.
